Terms of Use

These Terms of Use form a binding agreement between you and BC Studios Romania, the operator of GENR8 at genr8art.com. They apply when you create an account or otherwise use account-only features. If you do not agree, do not create or continue using an account.

The Privacy Notice explains how personal data is processed; it is a notice, not part of the permissions you grant us. The Content & Copyright Policy is incorporated into these Terms.

You must be at least 16 years old. If the law where you live requires parental or guardian authorisation for this service, you may use GENR8 only after that authorisation has been obtained.

You must provide accurate account information and use the Platform only where doing so is lawful.

• Keep your login credentials confidential and use a strong, unique password.
• Do not share, sell, transfer, or automate access to your account.
• Tell us promptly at contact@genr8art.com if you suspect unauthorised access.
• You are responsible for activity you authorise through your account. You are not responsible for activity caused by our breach of these Terms or failure to use reasonable security measures.

• Portfolio only: visible on the Platform, with no reuse licence granted to other users.
• Licensable: visible on the Platform and signals that interested parties may contact you; no licence exists until you separately agree its scope and price.
• Private: restricted to the account owner through access-controlled delivery; do not treat any online storage service as a substitute for your own secure archive.
• Publicly visible work can be viewed, photographed, screen-captured, or copied by third parties despite technical and contractual safeguards. GENR8 cannot guarantee that public content will never be copied.

Seeing content on GENR8 does not transfer any right to you. Unless the creator gives you a separate licence or applicable law permits the use, you may not download, scrape, repost, train models on, sell, alter, remove attribution from, or commercially exploit another creator's content.

Nothing in these Terms limits lawful quotation, criticism, review, parody, pastiche, or another mandatory copyright exception or limitation.

You are responsible for checking the terms and output restrictions of every AI service, dataset, model, or reference material used in your process. Labels about tools, prompts, or provenance must be truthful and must not suggest endorsement or authorship by another person.

GENR8 does not verify or guarantee the copyright status, originality, accuracy, or commercial usability of user content.

You must follow the Content & Copyright Policy. We may restrict visibility, remove content, limit features, suspend an account, or preserve evidence where reasonably necessary to enforce these Terms, protect users, comply with law, or secure the Platform.

Where required, we will explain a moderation decision and provide a way to challenge it. We may act without advance notice where urgent action is reasonably necessary, but this does not remove any appeal right provided by applicable law.

Rights holders and other persons may use the report controls or send a sufficiently precise notice to contact@genr8art.com. The required information, review process, counter-notice route, and safeguards against abusive notices are described in the Content & Copyright Policy.

We may share a notice with the affected user where necessary for a fair review, after removing information that should remain confidential.

GENR8's software, visual identity, branding, and operator-created materials are protected by applicable intellectual-property laws. These Terms give you only a personal, limited, revocable right to use the Platform as provided; they do not transfer the Platform's intellectual property.

• Accessing accounts, private content, systems, or data without authorisation.
• Scraping, crawling, bulk downloading, model-training extraction, or bypassing technical restrictions without written permission.
• Uploading malware, active scripts, deceptive files, or content intended to compromise another person or system.
• Harassment, impersonation, spam, manipulation of metrics, fraud, or evasion of enforcement actions.
• Using GENR8 in a way that violates law or the rights of another person.

The Platform may change, experience interruptions, or rely on third-party infrastructure. We will use reasonable care but do not promise uninterrupted or error-free availability.

Third-party links and AI tools have their own terms. Any paid plan will be governed by the price, billing period, cancellation information, and mandatory consumer rights shown before purchase. Nothing here removes a non-waivable statutory right.

Each party remains responsible for loss it causes by breaching these Terms or applicable law. To the maximum extent permitted by law, GENR8 is not responsible for indirect or unforeseeable loss, third-party misuse of content, or loss caused by events outside our reasonable control.

Nothing in these Terms excludes or limits liability where exclusion is prohibited, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory EU consumer rights.

You may stop using GENR8 and delete your account through Settings. We may suspend or terminate access for a material or repeated breach, a serious security risk, or a legal requirement. Where appropriate, we will give notice, reasons, and a reasonable opportunity to appeal.

Provisions that by their nature must survive—such as ownership, accrued payment obligations, legal claims, and lawful evidence preservation—continue after termination.

These Terms are governed by Romanian law and applicable European Union law. If you are an EEA consumer, you also retain mandatory protections and may bring proceedings in the courts available to you under applicable consumer law. Before litigation, contact us so we can attempt a good-faith resolution.

We will give reasonable advance notice of material changes unless an urgent legal or security reason requires a faster change. We will request renewed acceptance where the nature of a change requires it. Previous versions and acceptance records will be retained as needed to demonstrate the agreement that applied.
