1. Acceptance of Terms

Welcome to GENR8, operated by BC Studios Romania ("we", "us", "our"). By accessing or using genr8art.com ("the Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Platform.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GENR8.

2. Eligibility

You must be at least 16 years old to use GENR8. If you are between 16 and 18, you confirm that you have parental or guardian consent to use the Platform.

By using GENR8, you represent that all information you provide is accurate, current, and complete.

3. Your Account

You are responsible for:

  • - Maintaining the confidentiality of your login credentials
  • - All activity that occurs under your account
  • - Notifying us immediately of any unauthorised use at contact@genr8art.com
  • - We reserve the right to suspend or terminate accounts that violate these Terms.

4. Content You Post

You retain full ownership of all content you post on GENR8 ("User Content").

By posting content, you grant GENR8 a worldwide, non-exclusive, royalty-free licence to display, reproduce, and distribute your content solely for the purpose of operating and promoting the Platform.

You represent and warrant that:

  • - You own or have all necessary rights to the content you post
  • - Your content does not infringe any third-party intellectual property, privacy, or other rights
  • - You have the right to use any AI tool that generated your content, in accordance with that tool's terms of service
  • - Your content complies with these Terms and all applicable laws

5. AI-Generated Content

GENR8 is a platform for AI-generated and AI-assisted artwork. We do not claim ownership of AI-generated images posted by users.

You are solely responsible for ensuring your use of AI generation tools complies with those tools' terms of service, including any restrictions on commercial use, content ownership, and prohibited content.

The legal status of AI-generated content copyright varies by jurisdiction. You are responsible for understanding and complying with applicable copyright laws in your country.

6. Prohibited Content and Conduct

You may not post, upload, or share content that:

  • - Is illegal under applicable laws
  • - Infringes any copyright, trademark, or other intellectual property rights
  • - Contains explicit sexual content, nudity, or pornographic material
  • - Depicts or glorifies graphic violence or self-harm
  • - Constitutes hate speech or discriminates based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
  • - Harasses, bullies, threatens, or defames any individual
  • - Creates deceptive deepfakes of real people without their consent
  • - Impersonates any person or organisation
  • - Contains malware, viruses, or malicious code
  • - Violates any person's privacy rights
  • - Promotes or facilitates illegal activities
  • - Attempt to gain unauthorised access to the Platform or other users' accounts
  • - Scrape, crawl, or systematically extract data from the Platform
  • - Use the Platform to send spam or unsolicited communications
  • - Interfere with the Platform's operation
  • - Create multiple accounts to evade a suspension or ban

7. Content Moderation

We reserve the right to remove any content that violates these Terms at our sole discretion, without prior notice.

We reserve the right to suspend or permanently ban accounts that repeatedly violate these Terms or engage in harmful behaviour.

8. Intellectual Property

The GENR8 platform, including its design, code, branding, and non-user-generated content, is owned by BC Studios Romania and protected by applicable intellectual property laws.

You may not copy, modify, distribute, or create derivative works of the Platform without our express written permission.

9. DMCA and Copyright Infringement

If you believe content on GENR8 infringes your copyright, please send a notice to contact@genr8art.com including:

  • - Your full name and contact information
  • - Identification of the copyrighted work
  • - Identification of the infringing content and its location on the Platform
  • - A statement of good faith belief that the use is not authorised
  • - A statement that the information is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf

10. Third Party Links and Services

GENR8 may contain links to third-party websites and services. We are not responsible for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party services you use.

11. Disclaimer of Warranties

GENR8 is provided on an AS IS and AS AVAILABLE basis without warranties of any kind, either express or implied.

We do not warrant that:

  • - The Platform will be uninterrupted or error-free
  • - Defects will be corrected
  • - The Platform is free of viruses or harmful components
  • - The results obtained from use of the Platform will be accurate or reliable
  • - Your use of the Platform is at your sole risk.

12. Limitation of Liability

To the maximum extent permitted by applicable law, BC Studios Romania shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to loss of data, loss of profits, or business interruption.

Our total liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless BC Studios Romania, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • - Your use of the Platform
  • - Your User Content
  • - Your violation of these Terms
  • - Your violation of any third-party rights

14. Governing Law and Disputes

These Terms are governed by the laws of Romania and applicable European Union law.

Any disputes arising from these Terms or your use of GENR8 shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of the courts of Romania.

If you are an EU consumer, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr

15. Changes to Terms

We may update these Terms at any time. We will notify you of significant changes by posting a notice on the Platform. Continued use of GENR8 after changes constitutes acceptance of the updated Terms.

We recommend reviewing these Terms periodically.
